AI and Data Governance Today: GDPR Reform Trends and Research on Law and Technology

Abstract:

This talk introduces recent compliance practices surrounding AI and data, as well as research that explores the intersection of law and technology.

In the practical context of compliance, particular attention is given to the handling of personal data. For AI development intended for global deployment, adherence to the EU General Data Protection Regulation (GDPR) is essential. Consent and legitimate interest are typically relied upon as legal bases for processing data used in AI training, yet both present operational challenges in practice. On November 19, the European Commission announced the EU Digital Omnibus Proposal aimed at promoting innovation. Among its elements, the proposed amendments to the GDPR are expected to have the greatest practical impact. These revisions may make the use of personal data more permissive than before, thereby raising concerns about a potential weakening of data protection, while also increasing opportunities for data utilization in AI models.

In the research domain, the focus then shifts to the deletion of personal data from AI models, examining the legal significance of machine unlearning and the challenges of implementation. The data protection legislation of each jurisdiction (EU, United States, India, and Japan) is analyzed, and the legal applicability of machine unlearning are evaluated. As a result, more effective use of machine unlearning is expected in the development of the guidelines and legislation in the future.
