These terms of use (hereinafter "Terms") shall apply to your use of the Osaka University Multimodal Dialogue Corpus Hazumi, which is provided by the Institute of Scientific and Industrial Research (SANKEN), Osaka University (hereinafter "OU") through the National Institute of Informatics (hereinafter "NII"), a member of the Inter-University Research Institute Corporation Research Organization of Information and Systems.

(Definitions)
  1. In these Terms, the meanings of the terms listed in the following items shall be as set forth in each item.
    1. The Osaka University Multimodal Dialogue Corpus Hazumi (hereinafter the "Data") is a dataset of dialogues between persons and a system collected and created at the Institute of Scientific and Industrial Research (SANKEN), Osaka University and includes copies of the Data as well as related materials associated with the use of the Data.
    2. "Applicant" shall mean a legal entity that wishes to use the Data and has submitted the Application for Use as set forth in the following item.
    3. "Application for Use" means the prescribed application form submitted by the Applicant to OU through NII.
    4. "User" shall mean an Applicant who, after passing the screening by OU, submits a document (hereinafter "Agreement") certifying that the User agrees to these Terms and the terms of service prescribed by NII.
    5. "Researcher(s)" is a person(s) who is employed by a User (limited to a regularly enrolled person, such as a staff member or a student) and is the Principal Investigator written in the Application for Use (hereinafter "PI") or conducts research activities using the Data under the management and supervision of the PI in the same organization (regardless of the name of the laboratory, group, project, etc.) with the PI.
(License and Restriction of Use)
  1. In accordance with the Terms, OU grants the User a license to use the Data as follows. The use of the Data shall be free of charge.
    1. The User may use the Data only for academic research (including basic technology development), and the Data and data processed from the Data shall not be included in products, systems, services, etc. developed by the User.
    2. The Data contains personal facial images, voice records, etc. of research participants. The Users shall comply with applicable laws and their own regulations when using the Data. In addition, Users shall not engage in any of the following acts.
      1. Searching for information that leads to the identification of an individual using the contents of a dialogue, etc.
      2. Discussing the right or wrong of the facts, appropriateness, approval or disapproval of ideas, beliefs, lifestyles, etc. of the utterances or actions recorded in the video or audio data by linking them to specific individuals.
      3. Other actions that infringe on the personal information, privacy, or copyrights of the research participants or a third party.
    3. The Data may be used only by the Researcher(s). The User shall ensure that the Researcher(s) complies with conditions of the Terms and shall be responsible for any violation of conditions of the Terms by the Researcher(s).
    4. The User shall not disclose, provide, lend, publicly transmit (including making transmittable), or distribute the Data to any third party other than the Researcher(s) without prior written consent from OU.
    5. If OU requests the replacement of the Data, the User shall promptly stop using the Data in use ("Old Data"), switch to the use of the newly provided Data, and delete or erase the Old Data in response to OU's request.
    6. In the event of any changes to the information on the Application for Use or the Agreement, the User shall promptly notify OU and, if requested by OU, submit an updated Agreement.
(Method of Provision)
  1. The Data will be provided through NII. Unless otherwise specified, communication regarding the provision of the Data between the User and OU shall be conducted through the Informatics Research Data Repository (hereinafter "IDR") service of NII, in accordance with the terms of service prescribed by NII.
(Handling of Researcher Information, etc.)
  1. The User shall, in advance, notify the person who is to become the Researcher and obtain the consent from him/her about the fact that OU will use his/her personal information including his/her name, affiliation, and e-mail address in the Application for Use and the Usage Report, described in Article 8, for the purpose of service operations, such as contacting the User for providing the Data, statistics, and collecting, organizing, and analyzing research publications. (Those who do not consent will not be allowed to become the Researcher.)
(Management of the Data)
  1. The User shall take appropriate physical and technical information security measures for the computers, terminals and network devices, etc. (hereinafter "Computers") that use (including storage, processing, display, etc.) the Data.
  2. The User shall set up its Computers appropriately so that no one other than the Researcher(s) can access the Data.
  3. If the Data is reproduced on the Computers used by the Researcher(s), the Data shall be promptly deleted from the Computers when the Researcher(s) ceases to be a Researcher(s) due to retirement, graduation, etc.
  4. The User shall properly manage the Data in accordance with these Terms and the instructions on the IDR website. In particular, the User shall take measures to ensure safety as stipulated in laws and regulations regarding the protection of personal information and shall manage the use of the Data in accordance with rules and regulations established by the User.
  5. If there is any leakage or unauthorized access of the Data, the User shall promptly report to NII and follow the instructions of NII.
(Publication of Research Results)
  1. The User shall obtain permission from OU in advance if the User intends to publicize or report the results of research conducted using the Data (hereinafter the "Research Results") to the media (including when the User receives a request for an interview from the media).
  2. When the User publishes the Research Results, the User shall clearly indicate, by printing, video, broadcasting, or other directly perceivable methods, that the research was conducted using the Data provided by OU through NII in accordance with the designated notation.
  3. Even when making the Research Results public, the User shall not copy the Data beyond the reasonable degree for indicating examples in publications or other materials related to the Research Results, and shall not include information which possibly identifies specific individuals or possibly infringes human rights, privacy, etc. obtained from the Data. In particular, when indicating examples of images in the relevant materials, facial images shall be masked or appropriately treated, except when dealing with facial expressions. If it is necessary to play back the video/audio contained in the Data in oral or poster presentations, etc., it shall be kept to the minimum extent necessary to understand the point of arguments, and the organizer and the audience shall be warned before playing the video/audio so that they do not record it and distribute it on the Internet, etc.
  4. In the event of publication of the Research Results, the User shall submit to OU the printed materials or electronic data of the materials regarding the Research Results and the bibliographic information of the materials. The User shall agree that OU may use such bibliographic information for its publications, website, etc. and for the collection, organization, and analysis of the Research Results.
(Attribution of Research Results)
  1. The intellectual property rights related to the technology, systems, etc. developed by the User using the Data shall belong to the User.
  2. Except as expressly provided in these Terms, OU does not grant any rights to the User regarding the Data. The intellectual property rights of the Data are retained by OU and shall not be transferred to the User by providing the Data.
  3. Any intellectual property rights related to the results of analyses and other activities conducted by OU using the any data submitted by the User shall belong to OU.
(Submission of Usage Report)
  1. The User shall submit to OU a usage report on the usage status of the Data and research activities using the Data when requested by OU.
(Period)
  1. The effective period during which the User may use the Data (hereinafter "Period") shall be from the date NII provides the Data to the User (hereinafter "Date of Provision") to the end of the fiscal year (until March 31) to which the Date of Provision belongs. Provided, however, that the Period shall be automatically extended for one (1) year in the event that neither OU nor the User requests in writing to the contrary at least fifteen (15) days prior to the expiration date of the Period. Thereafter, the Period may be extended in the same manner.
  2. Even after the end of the Period, the provisions of Articles 5 through 8 and Articles 10 through 13 shall remain in effect until the obligations set forth in each of them are extinguished.
(Discontinuation of Use of Data)
  1. In the event that any of the following events occur, the User shall promptly stop using the Data and delete or erase the Data and all data obtained by processing the Data. The User shall also submit a written statement to the effect that the Data has been deleted or erased to OU if requested to do so by OU.
    1. When the Period has expired.
    2. When OU or NII terminates the provision of the Data.
    3. When the User requests the termination of the use of the Data.
    4. When OU judges that there is an act of violation of the Terms by the User and notifies the User to stop using the Data.
    5. When OU requests the User to discontinue the use of the Data based on other reasonable grounds.
  2. In the event that the User causes damage to OU as a result of violating these Terms, the User shall be liable to compensate OU for such damage, regardless of whether or not the provision of the Data is terminated.
(Disclaimer)
  1. This data is provided without any warranty, express or implied. Even if the purpose of use is stated in the Application of Use, OU does not guarantee that the Data will meet the User's purpose. OU shall not be liable for any damages incurred by the User, except as expressly provided for in the Terms. The User shall use the Data at the User's own risk and responsibility.
(Elimination of Antisocial Forces)
  1. The Applicant and the User shall represent and warrant that they do not have any affiliation with organized crime groups or their related parties, etc., now and will not in the future.
(Prohibition of Transfer)
  1. The User shall not transfer its position, rights, and obligations under these Terms to any third party without the prior written consent of OU.
(Language)
  1. These Terms are made in Japanese and translated into English. The Japanese text is the original and the English text is for reference purposes. If there is any conflict or inconsistency between these two texts, the Japanese text shall prevail.
(Dispute Resolution)
  1. In the event that any matter not stipulated in these Terms arises, or in the event that any dispute arises with respect to these Terms, the User shall consult with OU in good faith and endeavor to resolve the issue.
  2. These Terms shall be governed by the laws of Japan, and in the event that any legal action is necessary in relation to these Terms, the Osaka District Court shall have exclusive jurisdiction as the court of first instance.
(Amendment of the Terms)
  1. The contents of the Terms are subject to change, addition, or correction without prior notice to the User. Any changes, additions, or corrections will become effective when posted on the IDR website by OU.
